     Title of Rule and Other Identifying Information: WAC 246-830-460 Continuing education (CE) requirement -- Amount, this rule should be repealed. It is now obsolete because the language has been added to WAC 246-830-475.

NOTICE

     THIS RULE IS BEING PROPOSED UNDER AN EXPEDITED RULE-MAKING PROCESS THAT WILL ELIMINATE THE NEED FOR THE AGENCY TO HOLD PUBLIC HEARINGS, PREPARE A SMALL BUSINESS ECONOMIC IMPACT STATEMENT, OR PROVIDE RESPONSES TO THE CRITERIA FOR A SIGNIFICANT LEGISLATIVE RULE.      Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: This rule should be repealed because the language has been added to WAC 246-830-475, which was effective June 7, 2009. The changes are intended to provide clear continuing education requirements for massage practitioners and consolidate all continuing education requirements into one rule section.

     Reasons Supporting Proposal: The entire language from WAC 246-830-460 is obsolete. All the continuing education requirements are now under WAC 246-830-475 Continuing education requirements, which was filed with the code reviser's office on May 7, 2009, and became effective June 7, 2009.

     RCW 34.05.353 (2)(d) authorizes an expedited repeal of this rule because other rules of the agency govern the same activity of the rule, making the rule redundant.

     Statutory Authority for Adoption: RCW 18.108.025.

     Statute Being Implemented: RCW 18.108.025.

     Rule is not necessitated by federal law, federal or state court decision.
