Title of Rule and Other Identifying Information: Long-term care producer licensing and education rule repealing
WAC 284-54-750 which is superseded by WAC 284-17-262.
THIS RULE IS BEING PROPOSED UNDER AN EXPEDITED RULE-MAKING PROCESS THAT WILL ELIMINATE THE NEED FOR THE AGENCY TO HOLD PUBLIC HEARINGS, PREPARE A SMALL BUSINESS ECONOMIC IMPACT STATEMENT, OR PROVIDE RESPONSES TO THE CRITERIA FOR A SIGNIFICANT LEGISLATIVE RULE. Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: To repeal WAC 284-54-750, adopted in September of 1987. WAC 284-54-750 sets specific licensing certification and special education course requirements for licensees involved in the transaction of long-term care insurance. WAC 284-17-262 adopted in November 2008 supersedes the requirements of WAC 284-54-750.
Reasons Supporting Proposal: WAC 284-54-750 and 284-17-262 both relate to certification by an insurer of completion of long-term care insurance education due dates, and are inconsistent. This creates confusion for licensees required to submit information.
Statutory Authority for Adoption: RCW 48.83.170.
Statute Being Implemented: Chapter 48.83 RCW.
Rule is not necessitated by federal law, federal or state court decision.
