     Effective Date of Rule: January 1, 2010.

     Purpose: The department is proposing to amend by emergency adoption WAC 388-478-0015 in order to allow the revised basic need standards for cash assistance programs to be in place by January 1, 2010, as it is required by RCW 74.04.770. The department [is] pursuing permanent adoption of these rules. The preproposal statement of inquiry was filed under WSR 09-14-017 on June 22, 2009; the proposed rule making CR-102 was filed under WSR 09-24-014 on November 23, 2009, and the public hearing is scheduled for January 5, 2010.

     Citation of Existing Rules Affected by this Order: Amending WAC 388-478-0015.

     Statutory Authority for Adoption: RCW 74.04.050, 74.04.055, 74.04.057, 74.04.770, and 74.08.090.

     Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest; that state or federal law or federal rule or a federal deadline for state receipt of federal funds requires immediate adoption of a rule; and that in order to implement the requirements or reductions in appropriations enacted in any budget for fiscal years 2009, 2010, or 2011, which necessitates the need for the immediate adoption, amendment, or repeal of a rule, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the fiscal needs or requirements of the agency.

     Reasons for this Finding: It is essential to have revised basic need standards to be in place by January 1, 2010, as it is required by RCW 74.04.770 to continue to provide cash assistance programs while [the] department is pursuing normal rule adoption.
