INTERPRETIVE AND POLICY STATEMENT

     In accordance with RCW 34.05.230(12), following is a policy and interpretive statement issued by the department regarding the insurance services division policies.

Insurance Services: Claims Administration, Self Insurance and Crime Victims New Policy 11.20, Authorizing Vehicle Modifications. RCW 51.36.020(8) and WAC 296-20-1102, 296-23-180.

     The policy outlines the eligibility requirements and process for authorizing vehicle modifications. The supervisor of industrial insurance must preapprove vehicle modifications for state fund claims and deny vehicle modifications for state fund and self-insured claims. Only workers with amputation or paralysis may be eligible for vehicle modification benefits. When authorized, the vehicle modification benefit is fifty percent of the state's average annual wage. If the modification exceeds the benefit, the supervisor of industrial insurance has the discretion to authorize up to an additional $4,000. The worker must be the registered owner of the vehicle. Modifications may be considered under a new benefit in certain circumstances.
