Subject of Possible Rule Making: WAC 392-122-160 State special education program—Reporting.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 28A.150.290.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: WAC 392-122-160 requires updating to change the age reporting requirement for special education students. Starting in the 2013–14 school year, the student's age will be determined by the student's birthday. Two-year-old special education students that turn three during the school year will be reported in the age 3–5 category.
Process for Developing New Rule: Early solicitation of public comments and recommendations respecting new, amended, or repealed rules, and consideration of the comments and recommendations in the course of drafting rules.
