EMERGENCY RULES
DEPARTMENT OF
FISH AND WILDLIFE
[Order 16-124—Filed May 27, 2016, 1:34 p.m., effective June 2, 2016, 6:00 a.m.]
Effective Date of Rule: June 2, 2016, 6:00 a.m.
Purpose: Amend Puget Sound recreational crab fishing rules.
Citation of Existing Rules Affected by this Order: Repealing WAC 220-56-33000Y; and amending WAC 220-56-330.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, and 77.12.047.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: An emergency rule is needed to open the recreational crab harvest in Marine Areas 12, 13 and a portion of Marine Area 9 to achieve the 50/50 harvest defined by the federal court order. Recreational crab fisheries will open at 6:00 a.m. on the first day instead of 7:00 a.m. in each of the marine areas. There is insufficient time to adopt permanent rules.
