PREPROPOSAL STATEMENT OF INQUIRY

Subject of Possible Rule Making: Chapter 246-xxx WAC, Donation of prescription drugs, the pharmacy quality assurance commission (commission) is considering creating a new chapter to set standards for the donation of prescription drugs and supplies as allowed in chapter 69.70 RCW.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 18.64.005, chapter 69.70 RCW, ESHB 2458 (chapter 43, Laws of 2016).
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: ESHB 2458 takes effect January 1, 2017. The bill amends chapter 69.70 RCW by allowing an individual person to whom a prescription drug was prescribed, or a person's representative, to donate prescription drugs and supplies, under certain circumstances, to a participating pharmacy. Rule making will be necessary to implement standards for receipt, storage, and redistribution of prescription drugs and supplies to comply with existing chapter 69.70 RCW and the additional new amendments enacted by ESHB 2458.

Process for Developing New Rule: Collaborative rule making.
Interested parties can participate in the decision to adopt the new rule and formulation of the proposed rule before publication.
