PREPROPOSAL STATEMENT OF INQUIRY
DEPARTMENT OF
LABOR AND INDUSTRIES
[Filed December 22, 2020, 4:11 p.m.]
Subject of Possible Rule Making: WAC 296-900-13015 Posting citation and notices, the purpose of this state initiated rule making is to change the length of time that a citation and notice, and any correspondence related to an employee complaint, needs to be posted on an employee safety bulletin board in WAC 296-900-13015. The department is considering changing the amount of time, will be updated from three working days to seven working days.
Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 49.17.010, 49.17.040, 49.17.050, 49.17.060, and 49.17.120.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Employers are currently required to post a citation and notice for three working days for employees to see. There are employees who work nonstandard shifts that may not have access to this information due to the short amount of time the citation and notice is actually posted. The department believes worker safety could be improved if all employees have access to corrective action information.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: Not applicable.
Process for Developing New Rule: Parties interested in the formulation of these rules for proposal may contact the individual listed below. The public may also participate by commenting after amendments are proposed by providing written comments or giving oral testimony during the public hearing process.
Interested parties can participate in the decision to adopt the new rule and formulation of the proposed rule before publication by contacting Tari Enos, P.O. Box 44620, Olympia, WA 98504-4620, phone 360-902-5541, fax 360-902-5619, email tari.enos@Lni.wa.gov.
