Pursuant to RCW 34.05.314, this report describes current and anticipated rule development activities for the liquor and cannabis board (LCB). If you have any questions regarding this report or LCB rule development activities, please contact Katherine Hoffman, LCB policy and rules manager, at 360-664-1622 or katherine.hoffman@lcb.wa.gov.
This agenda is for informational purposes, and the noted dates of anticipated rule-making actions are estimates. Any errors in the agenda do not affect the rules and rule-making notices filed with the office of the code reviser and published in the Washington State Register. There may be additional LCB rule development activities that cannot be forecasted as the agency initiates rule making to implement new state laws, meet federal requirements, or meet unforeseen circumstances. The "Key" below explains terms and acronyms.
KEY
CR: "Code reviser" on the notice forms created by the office of the code reviser for use by all state agencies.
CR-101: Preproposal statement of inquiry filed under RCW 34.05.310.
CR-102: Proposed rule making notice filed under RCW 34.05.320 or 34.05.340.
CR-103: Rule-making order permanently adopting a rule, and filed under RCW 34.05.360 and 34.05.380.
RCW: Revised Code of Washington.
WAC: Washington Administrative Code.
WSR: Washington State Register official filing reference number given by the office of the code reviser when a notice is filed.

WAC 314-03-XXX Axe throwing at liquor licensed premises. LCB is considering creating a new rule section and amending or repealing other related rules in Title 314 WAC as necessary to allow the added activity of axe throwing at liquor licensed premises.

WAC 314-55-101 Quality assurance sampling protocols, 314-55-102 Quality assurance testing, and 314-55-1025 Proficiency testing. LCB proposes amendments to current marijuana product testing standards to require pesticide testing for all marijuana produced, processed, and sold in Washington state, and randomized or investigation driven testing of marijuana for heavy metals.

Chapter 314-55 WAC concerning social equity in cannabis. LCB is considering new rules in response to future recommendations of the social equity in cannabis task force, and changes to current rule that will reduce barriers to entry in the legal cannabis market. Additional rules specifically related to this topic may be amended or created as necessary to accomplish the overarching goal of this project.

Electronic service of certain notices. LCB is considering amending rule sections in chapters 314-07, 314-09, 314-029, 314-42 WAC, and other related rules as may be required to allow LCB to serve certain legal notices electronically. LCB is also considering amending rules in these chapters to allow LCB to accept documents related to license applications and appeals through electronic submission.
