Effective Date of Rule: October 1, 2022.
Purpose: The agency is repealing WAC 182-538D-0262 Behavioral health administrative service organizations and managed care organizationsBehavioral health ombuds office. These revisions will align with the new statewide ombuds program under chapter 71.40 RCW that takes effect October 1, 2022.

Statutory Authority for Adoption: RCW 41.05.021, 41.05.160.
Under RCW 34.05.350 the agency for good cause finds that immediate adoption, amendment, or repeal of a rule is necessary for the preservation of the public health, safety, or general welfare, and that observing the time requirements of notice and opportunity to comment upon adoption of a permanent rule would be contrary to the public interest.
Reasons for this Finding: Currently, WAC 182-538D-0262 provides that a behavioral health administrative service organization (as defined under WAC 182-538-050) must maintain a behavioral health ombuds office for medicaid managed care enrollees. Chapter 71.40 RCW subsequently established the office of behavioral health consumer advocacy administered by the department of commerce, effective October 1, 2022. To align with this change, the agency must repeal WAC 182-538D-0262, effective October 1, 2022.
