WSR 25-11-088
EXPEDITED RULES
DEPARTMENT OF
FISH AND WILDLIFE
[Order 25-10—Filed May 21, 2025, 10:14 a.m.]
Title of Rule and Other Identifying Information: Improving accessibility, updating taxonomy, and correcting typographical and spelling errors in invasive/nonnative species, food fish listings, including WAC 220-640-030 Prohibited level 1 species, 220-640-050 Prohibited level 3 species, 220-640-060 Regulated Type A species, 220-300-370 Food fishClassification, 220-300-380 Game fishClassification, and 220-320-010 ShellfishClassification.
Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: The Washington department of fish and wildlife (WDFW) is amending sections of chapters 220-640, 220-300, and 220-320 WAC by correcting typographic errors and taxonomic errors. WDFW is also reordering and alphabetizing listed species within WAC 220-640-030, 220-640-050, and 220-640-060 to increase accessibility, understanding, and legal compliance. No additional changes or additions are proposed. These corrections relate back to the initial adoption date of the WAC chapter in 2017 (WAC 220-300-380), 2019 (WAC 220-640-030, 220-640-050, and 220-640-060), and 2022 (WAC 220-300-370 and 220-320-015 [220-320-010]).
Reasons Supporting Proposal: In the fall of 2024, WDFW was alerted to a taxonomic reference error and misspelling of mitten crab in WAC 220-640-030. WDFW initiated rule making by subsequently filing WSR-24-23-055 on November 14, 2024, amending and correcting the reference. While preparing initial information for expedited rule making, WDFW identified several other taxonomic and spelling reference errors in Title 220 WAC. This rule making will correct the identified reference errors, in addition to reorganizing the structure for improved accessibility, understanding, and legal compliance.
Statutory Authority for Adoption: RCW 77.04.012, 77.04.020, 77.04.055, 77.12.045, 77.04.013, and 77.12.047.
Statute Being Implemented: RCW 77.04.012, 77.04.020, 77.04.055, 77.12.045, 77.04.013, and 77.12.047.
Rule is not necessitated by federal law, federal or state court decision.
Name of Proponent: WDFW, fish program aquatic invasive species division, governmental.
Name of Agency Personnel Responsible for Drafting: Justin Bush, 1111 Washington Street S.E., Olympia, WA 98501, 564-669-9486; Implementation: Kelly Cunningham, 1111 Washington Street S.E., Olympia, WA 98501, 360-902-2700; and Enforcement: Chief Steve Bear, 1111 Washington Street S.E., Olympia, WA 98501, 360-902-2936.
Agency Comments or Recommendations, if any, as to Statutory Language, Implementation, Enforcement, and Fiscal Matters: Recommendation to review listings each biennium, initiating rule making for taxonomic reference errors or updates as needed.
This notice meets the following criteria to use the expedited adoption process for these rules:
Corrects typographical errors, makes address or name changes, or clarifies language of a rule without changing its effect.
Explanation of the Reason the Agency Believes the Expedited Rule-Making Process is Appropriate: Expedited rule making is appropriate because the amendments being made to WAC 220-640-030, 220-640-050, 220-640-060, 220-300-370, 220-300-380, and 220-320-015 [220-320-010] are correcting typographical errors in species names, addressing taxonomic name changes, and clarifying language. The rule making also seeks to organize sections alphabetically to improve accessibility, understanding, and legal compliance.
NOTICE
THIS RULE IS BEING PROPOSED UNDER AN EXPEDITED RULE-MAKING PROCESS THAT WILL ELIMINATE THE NEED FOR THE AGENCY TO HOLD PUBLIC HEARINGS, PREPARE A SMALL BUSINESS ECONOMIC IMPACT STATEMENT, OR PROVIDE RESPONSES TO THE CRITERIA FOR A SIGNIFICANT LEGISLATIVE RULE. IF YOU OBJECT TO THIS USE OF THE EXPEDITED RULE-MAKING PROCESS, YOU MUST EXPRESS YOUR OBJECTIONS IN WRITING AND THEY MUST BE SENT TO Scott Bird, Rules Coordinator, WDFW, P.O. Box 43200, Olympia, WA 98501, phone 360-902-2403, fax 360-902-2155, email rules.coordinator@dfw.wa.gov, AND RECEIVED BY July 22, 2025, 11:59 p.m.
