Title of Rule and Other Identifying Information: Improving accessibility, updating taxonomy, and correcting typographical and spelling errors in invasive/nonnative species, food fish listings, including WAC 220-640-030 Prohibited level 1 species, 220-640-050 Prohibited level 3 species, 220-640-060 Regulated Type A species, 220-300-370 Food fish—Classification, 220-300-380 Game fish—Classification, and 220-320-010 Shellfish—Classification.
Purpose of the Proposal and Its Anticipated Effects, Including Any Changes in Existing Rules: The Washington department of fish and wildlife (WDFW) is amending sections of chapters 220-640, 220-300, and 220-320 WAC by correcting typographic errors and taxonomic errors. WDFW is also reordering and alphabetizing listed species within WAC 220-640-030, 220-640-050, and 220-640-060 to increase accessibility, understanding, and legal compliance. No additional changes or additions are proposed. These corrections relate back to the initial adoption date of the WAC chapter in 2017 (WAC 220-300-380), 2019 (WAC 220-640-030, 220-640-050, and 220-640-060), and 2022 (WAC 220-300-370 and 220-320-015 [220-320-010]).
Reasons Supporting Proposal: In the fall of 2024, WDFW was alerted to a taxonomic reference error and misspelling of mitten crab in WAC 220-640-030. WDFW initiated rule making by subsequently filing WSR-24-23-055 on November 14, 2024, amending and correcting the reference. While preparing initial information for expedited rule making, WDFW identified several other taxonomic and spelling reference errors in Title 220 WAC. This rule making will correct the identified reference errors, in addition to reorganizing the structure for improved accessibility, understanding, and legal compliance.
Rule is not necessitated by federal law, federal or state court decision.

The rule making also seeks to organize sections alphabetically to improve accessibility, understanding, and legal compliance.
