Subject of Possible Rule Making: Implementation of E2SHB 1432 (2025), improving access to appropriate mental health and substance use disorder services.
Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: The office of the insurance commissioner (OIC) is considering rule making due to the recent passage of E2SHB 1432 and other changes in law. Multiple provisions of health care and insurance regulations in WAC may need to be updated by OIC to be consistent with the legislation passed and codified in RCW.
This rule making may include, but is not limited to, improving access to appropriate mental health and substance use disorder services. This rule making may create new sections in chapter 284-43 WAC and may include, but is not limited to, the following authorities: Chapter 284-43 WAC, subchapter K; WAC 284-43-0160, 284-43-2000, 284-43-2020, 284-43-2021, 284-43-2050, 284-43-3030, 284-43-3070, 284-43-4040, 284-43-5130, and 284-170-130.
Other Federal and State Agencies that Regulate this Subject and the Process Coordinating the Rule with These Agencies: OIC is promulgating administrative regulations related to the commercial plans it regulates. However, there are other state agencies that may be affected by the legislation requiring this rule making.
The health care authority (HCA) is affected by the new mental health and substance use disorder legislation. Therefore, OIC will coordinate on this rule making with HCA by offering notice and opportunity for written comment or feedback with multiple participation forums.
Process for Developing New Rule: Submit written comments by September 17, 2025.
