RESCISSION OF EMERGENCY RULES

On November 19, 2025, the Washington state office of superintendent of public instruction (OSPI) filed a CR-103P rule-making order (WSR 25-24-001) concerning permanent rule making for WAC 392-123-140. As indicated in WSR 25-24-001, the permanent rule updates will become effective on December 20, 2025.

OSPI filed a CR-103E emergency rule-making order (WSR 25-12-030) on May 27, 2025. The emergency rule-making order was renewed on September 24, 2025 (WSR 25-20-038), to ensure that the emergency rules continue to remain in place until the permanent rules take effect.

Because the most recent emergency rule renewal filing will still be in effect on the same day that the permanent rules become effective, OSPI must rescind WSR 25-20-038 in order to avoid any overlap between the emergency rules and permanent rules.

Therefore, this document serves as official notification that OSPI is rescinding WSR 25-20-038, effective December 20, 2025.
