PREPROPOSAL STATEMENT OF INQUIRY

DEPARTMENT OF TRANSPORTATION

Subject of Possible Rule Making: Turnback agreements, including definitions and the purpose for such agreements. It will also lay out the agreement process for both the department of transportation and local agencies.

Statutes Authorizing the Agency to Adopt Rules on this Subject: RCW 36.75.090 and chapter 39.33 RCW.

Reasons Why Rules on this Subject may be Needed and What They Might Accomplish: Clarification is needed to provide adequate processes and rules related to the use of turnback agreements as none are currently in place.

Process for Developing New Rule: Agency study.
