Semi-Annual Agenda for Rules Under Development
January 1 - June 30, 2026
DIVISION OF BANKS
Updates to the bank/trust related WAC, chapter 208-512 through 208-598 WAC. The division of banks (division) plans to begin the process to propose amendments to the banking and trust related WAC to ensure the WAC correspond properly to the updated RCW (the splitting of Title
30 RCW into Titles
30A and
30B RCW) and incorporate updates similar to federal laws and guidance. These WAC have not been updated in several years and some areas need correction, clearer language, and modernization. These changes will provide applicants, banks, and trust companies clarity and provide more comprehensive guidance to compliment the RCW and the division's practices.
DIVISION OF CONSUMER SERVICES
Check Cashers and Sellers Act. Begin, finalize, and adopt rules under chapter 208-660 WAC to clarify the requirements related to data security and notification of security events, and to make technical or other changes as may be required by changes to state or federal law.
Consumer Loan Act. Finalize and adopt the rule makings related to the Predatory Loan Prevention Act (SSB 6025) and home equity sharing agreements. The preproposal statement of inquiry (form CR-101) for each rule making was filed on March 10, 2025. The proposed rule making (form CR-102) for the Predatory Loan Prevention Act was filed on August 21, 2025. Begin, finalize, and adopt rules under chapter 208-620 WAC to clarify the requirements related to advertising, permissible fees, and data security and notification of security events. Further, make technical or other changes as may be required by changes to state or federal law.
Escrow Agent Registration Act. Begin, finalize, and adopt rules under chapter 208-680 WAC to clarify the requirements related to contract collection activity and data security and notification of security events. Also, make technical or other changes as may be required by changes to state or federal law.
Mortgage Broker Practices Act. Begin, finalize, and adopt rules under chapter 208-660 WAC to clarify the requirements related to advertising, permissible fees, and data security and notification of security events. Also, make technical or other changes as may be required by changes to state or federal law.
Uniform Money Services Act. Begin, finalize, and adopt rules under chapter 208-690 WAC to add provisions to strengthen consumer protections related to virtual currency, and clarify the requirements related to data security and notification of security events. Also, make technical or other changes as may be required by changes to state or federal law.
DIVISION OF SECURITIES
Updates to the investment adviser rules in chapter 460-24A WAC. The division of securities (division) plans to propose amendments to the investment adviser rules contained in chapter 460-24A WAC to incorporate updates to similar rules adopted by the United States Securities and Exchange Commission and North American Securities Administrators Association (NASAA), including advertising rules, continuing education requirements, and rules concerning unpaid arbitration awards.
Updates to the small company offering registration (SCOR) rules in chapter 460-17A WAC: The division plans to propose amendments to the SCOR rules contained in chapter 460-17A WAC to incorporate updates, including updates to the NASAA SCOR statement of policy.
Updates to the franchise rules in chapter 460-80 WAC. The division plans to propose amendments to the franchise rules contained in chapter 460-80 WAC to incorporate updates, including updates to NASAA model rules applicable to franchise offerings.
Dishonest and unethical business practices of franchise brokers. The division plans to propose a new rule to be codified in chapter 460-82 WAC to list certain acts or practices that are deemed dishonest or unethical business practices of franchise brokers.
