     On page 55, after line 11, insert the following:

     "NEW SECTION. Sec. 24.  A new section is added to chapter 71.09 RCW to read as follows:

     If this chapter is held invalid by the Washington supreme court, then the punishment for offenders convicted of a sexually violent offense as defined in RCW 9.94A.030 shall be life imprisonment without the possibility of release, community custody, or parole.

     This section shall not take effect unless the supreme court of Washington in a final decision holds that chapter 71.09 RCW is invalid.  If the Washington supreme court holds in a final decision that chapter 71.09 RCW is invalid, this section shall take effect on the date that the Washington supreme court issues its final decision and shall apply to all crimes committed on or after the effective date of this section."

     Renumber the remaining sections consecutively and correct internal references accordingly.

EFFECT:  Provides that if the Washington supreme court invalidates chapter 71.09 RCW, then the punishment for offenders convicted of a sexually violent offense as defined in RCW 9.94A.030 shall be life imprisonment without the possibility of release, community custody, or parole, and that this section shall not become effective until the date the court issues its final decision.
