     On page 39, line 11, strike all of subsection (4) and insert the following:

     "(4) Members of the legislature, as elected representatives of the people, and other public employees, including members of a bargaining unit, are servants of the people and are accountable to them.  In order to most appropriately meet the requirements of Article VIII, section 4 of the state Constitution and fulfill the legislature's responsibility to establish policy and to fully consider and determine the purposes and levels of state expenditures, collective bargaining agreements are subject to subsequent modification by the legislature and the legislature may unilaterally increase, reduce, eliminate, or otherwise modify provisions of collective bargaining agreements pertaining to compensation or benefits.  An action by the legislature that increases, reduces, eliminates, or otherwise modifies provisions of the collective bargaining agreement pertaining to compensation or benefits contained is final and binding on the parties to the agreement until after the expiration of the collective bargaining agreement and a new collective bargaining agreement is ratified and either approved, rejected, or modified by the legislature."

 

     On page 44, line 19, after "act." insert "The right to strike may not be exercised because of an action by the legislature that increases, reduces, eliminates, or otherwise modifies provisions of the collective bargaining agreement pertaining to compensation or benefits."


 

 

 

 

EFFECT:  Provides that the Legislature may unilaterally modify provisions of collective bargaining agreements pertaining to compensation or benefits and that such actions by the Legislature are final and binding on the parties and that the right to strike may not be exercised because of such actions by the Legislature.
