     On page 44, after line 32, insert the following:

     "NEW SECTION. Sec. 310.  A person or entity who is injured as a result of an illegal strike, work slowdown, or work stoppage by public employees, or other illegal refusal by public employees to perform their official duties in a full, faithful, and proper manner, may bring a civil cause of action against an organization recognized as a bargaining representative of employees and an employee who caused injuries to the person by engaging in such illegal activities.  The organization and employee may be liable to the injured person or entity for actual damages, punitive damages of up to ten thousand dollars, and reasonable attorneys' fees and costs incurred in bringing the action.  The superior court may grant temporary and final injunctions on such terms as it deems reasonable to prevent or restrain injuries caused to a person or entity as a result of such illegal activities."

     Renumber the remaining sections consecutively and correct internal references accordingly.

EFFECT:  Creates a civil cause of action for damages, attorney fees, costs, and punitive damages by persons or entities injured as a result of an illegal strike, work slowdown, or work stoppage by public employees.
