    On page 1, line 7, before "NEW SECTION" insert the following:

    "NEW SECTION. Sec. 1.  (1) Any manufacturer of a tobacco product, sold within the state of Washington, shall be required to compensate any resident of the state of Washington for any costs incurred by participating in a medically accepted treatment for nicotine addiction.  This addiction must be caused, at least in part, by such resident inhaling or chewing a tobacco product produced by such manufacturer.

    (2) Each manufacturer may be held jointly and severally responsible for the costs of such treatment.

    (3) In order to receive compensation from a manufacturer of a tobacco product, a resident must provide the insurance commissioner with verification of the use of a tobacco product, the manufacturer of such product, the type of medically accepted treatment received by the resident and the cost of such treatment.

    (4) Upon receipt of the information described in subsection (3), the insurance commissioner shall seek payment from at least one manufacturer of a tobacco product sold within the state of Washington.  Upon receipt of payment, the commissioner shall reimburse the resident in question.

    (5)  A resident may receive compensation under this section if such resident is addicted to nicotine at the time of treatment, regardless of whether such resident was using a tobacco product at the time of the treatment."

    Renumber the remaining sections consecutively and correct any internal references accordingly.
