Background: A statute relating to school transportation costs, RCW 28A.150.280, was amended twice by the Legislature in 1981. The amendments were inconsistent.
One amendment, Chapter 265, Laws of 1981, created an allocation system for reimbursement of school transportation costs.
The other amendment, Chapter 343, Laws of 1981, excluded reimbursement for the costs of transporting a student to any school other than one geographically nearest or next nearest to the student's residence. In 1981, a federal court held that exclusion to be unconstitutional.
The Law Revision Commission recommends reenactment of Chapter 265, Laws of 1981, thus eliminating the unconstitutional provision.
