Regulating advertising for the state lottery.

          AN ACT Relating to the state lottery; amending RCW 67.70.010; and adding a new section to chapter 67.70 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

        Sec. 1.  RCW 67.70.010 and 1987 c 511 s 1 are each amended to read as follows:

          For the purposes of this chapter:

          (1) "Commission" means the state lottery commission established by this chapter;

          (2) "Lottery" or "state lottery" means the lottery established and operated pursuant to this chapter;

          (3) "Director" means the director of the state lottery established by this chapter;

(4) "Promotional advertising" means advertising that goes beyond communicating the informational facts concerning the lottery and is primarily intended to induce persons to participate in the lottery.

NEW SECTION. Sec. 2.  A new section is added to chapter 67.70 RCW to read as follows:

          (1) The expenditure of public funds or state lottery revenue by the commission or any other state agency for promotional advertising of the state lottery is prohibited.

          (2) All advertising of a lottery game shall include a prominent and clear statement of the odds of winning the grand prize and the overall odds of winning any prize offered in the lottery game.

          (3) Advertising of a lottery game may include:

          (a) Types of lottery games offered;

          (b) Prices of tickets or shares in the lottery;

          (c) Number and sizes of the prizes on winning tickets or shares;

          (d) Proportion of lottery revenues disbursed as prizes;

          (e) Manner in which lottery revenues are used;

          (f) Manner of selecting the winning tickets or shares;

          (g) Manner of payment of prizes to the holders of winning tickets or shares;

          (h) Numbers of the winning tickets or shares and amounts won by the holders of the winning tickets or shares;

          (i) Frequency of the drawings of winning tickets or shares; and

          (j) Locations at which tickets or shares may be sold.
