Prohibiting hazardous waste incinerators within two miles of farm or agricultural land.

          AN ACT Relating to siting hazardous waste incinerators near agricultural land; and adding a new section to chapter 70.105 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 70.105 RCW to read as follows:

          The department shall not issue a permit for a facility to incinerate hazardous waste, moderate-risk waste, or hazardous substances if the facility is located within two miles of farm or agricultural land, as defined in RCW 84.34.020, that is used for commercial agriculture.  "Commercial agriculture" means farming activities that make up fifty percent of the income of the person who owns the farm or agricultural land.
