AN ACT Relating to state minimum wage requirements at institutions of higher education; and amending RCW 49.46.020 and 49.46.060.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
Sec. 1. RCW 49.46.020 and 1993 c 309 s 1 are each amended to read as follows:
(1) Except as otherwise provided in this chapter, every employer shall pay to each of his or her employees who has reached the age of eighteen years wages at a rate of not less than four dollars and ninety cents per hour.
(2) The director shall by regulation establish the minimum wage for employees under the age of eighteen years.
Sec. 2. RCW 49.46.060 and 1959 c 294 s 6 are each amended to read as follows:
The director, to the
extent necessary ((in order)) to prevent curtailment of opportunities
for employment, shall by ((regulations)) rule provide for:
(1) The
employment of learners, of apprentices, and of messengers employed primarily in
delivering letters and messages, under special certificates issued ((pursuant
to regulations of)) by the director, at such wages lower than the
minimum wage applicable under RCW 49.46.020 and subject to such limitations as
to time, number, proportion, and length of service as the director shall
prescribe((, and));
(2) The employment of individuals whose earning capacity is impaired by age or physical or mental deficiency or injury, under special certificates issued by the director, at such wages lower than the minimum wage applicable under RCW 49.46.020 and for such period as shall be fixed in such certificates; and
(3) The employment by an institution of higher education, under special certificates issued by the director, at a wage rate not less than eighty-five percent of the rate applicable under RCW 49.46.020(1) of full-time students who are enrolled in the institution of higher education that employs the student. The director shall adopt by rule standards and requirements to ensure that this subsection does not create a substantial probability of reducing the full-time employment opportunities of persons other than those to whom the minimum wage rate authorized under this subsection applies. A special certificate issued under this subsection shall provide that the student for whom it is issued shall be employed on a part-time basis and not be employed for more than twenty hours in any work week, except during vacation periods.
