Requiring school facilities be made available for activities or services for children.



    AN ACT Relating to community-based programs for children at school facilities; amending RCW 28A.320.510; creating a new section; and providing an effective date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 28A.320.510 and 1969 ex.s. c 223 s 28A.58.105 are each amended to read as follows:

    (1) Every board of directors, unless otherwise specifically provided by law, shall:

    (((1))) (a) Authorize school facilities to be used for night schools and establish and maintain the same whenever deemed advisable;

    (((2))) (b) Authorize school facilities to be used for summer schools or for meetings, whether public, literary, scientific, religious, political, mechanical, agricultural or whatever, upon approval of the board under such rules or regulations as the board of directors may adopt, which rules or regulations may require a reasonable rental for the use of such facilities.

    (2) Every board of directors, unless otherwise specifically provided by law, shall authorize school facilities to be used by volunteer or nonprofit community organizations for the purposes of before and after school child care, programs to serve children at risk, and other community-based programs designed to provide services or activities for children.  School facilities shall be made available upon adoption by the board of directors of rules or regulations governing the use of school facilities, which shall not require rental for the use of such facilities.

 

    NEW SECTION.  Sec. 2.  The superintendent of public instruction shall collect information from school districts and conduct a study regarding direct costs potentially incurred by school districts in fulfilling the requirements of RCW 28A.320.510(2).  The superintendent shall report to the education committees of the legislature by January 1, 1995, regarding the costs of implementing RCW 28A.320.510(2) and recommendations for compensating school districts for such expenses.

 

    NEW SECTION.  Sec. 3.  Section 1 of this act shall take effect July 1, 1995.
