On page 2, after line 33, insert the following:
"(5) So as to safeguard the sanctity of the family, the department of corrections shall not intercept, record, or divulge any conversation occurring between an inmate and a member of the inmate's immediate family when the family member is visiting the inmate in a state correctional facility, unless the department has probable cause to believe a crime is being committed or discussed. "Immediate family" is as defined in RCW 72.09.015."
Re-number remaining subsections and correct any internal references accordingly.
On page 3, after "the facility." on line 6, insert "The notice shall indicate that conversations between an inmate and a member of the inmate's immediate family while the family member is visiting at the facility cannot be intercepted, recorded, or divulged."
EFFECT: The Department of Corrections' authorization to intercept, record or divulge conversations occurring at a DOC facility is limited so that DOC cannot intercept, record or divulge conversations occurring during an in-facility visit between an inmate and a member of the inmate's immediate family. "Immediate family" means the inmate's spouse, children, stepchildren, grandchildren, great grandchildren, parents, stepparents, grandparents, great grandparents, and siblings.
