On page 5, beginning after line 9, strike all matter through "gross misdemeanor." on line 17 and insert:
"(7) A person who
knowingly fails to register or who moves without notifying the county sheriff
as required by this section is guilty of a class C felony ((if the crime for
which the individual was convicted was a class A felony or a federal or
out-of-state conviction for an offense that under the laws of this state would
be a class A felony. If the crime was other than a class A felony or a federal
or out-of-state conviction for an offense that under the laws of this state
would be a class A felony, violation of this section is a gross misdemeanor))."
EFFECT: Provides that failing to register as a sex offender, or failing to notify the sheriff about an address change, is always a Class C felony regardless of the nature of the underlying sex offense. Under current law, a failure to register or to notify the sheriff can be either a Class C felony or a gross misdemeanor, depending on whether the underlying sex offense was a Class A felony.
