     On page 8, after line 3 of the amendment, insert the following:

     "(2) Notwithstanding the requirements of subsection (1) of this section, a public water system that does not have a certified operator on the effective date of this act is not required to have a certified operator unless the department finds that the system is in significant noncompliance with monitoring or water quality standards, as defined by the department by rule."

Renumber the remaining subsections consecutively and correct internal references accordingly.

     On page 8, line 27 of the amendment, after "satisfied." strike all material down to and including "requirements." on line 35

EFFECT:  Requires the Dept. of Health to show that a system without a certified operator is in significant noncompliance before a certified operator can be required.  Waiver language is removed.
