     On page 4, after line 4 of the amendment, insert the following:

     "NEW SECTION. Sec. 3.  As of the effective date of this act, the department of ecology may not issue a permit for a municipal solid waste landfill facility if the active active area of the facility is located within one thousand feet of land that is zoned as residential.

NEW SECTION. Sec. 4.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately."

     Renumber remaining sections consecutively, correct internal references accordingly, and correct the title.

EFFECT:  Prohibits the Department of Ecology from issuing a permit for a solid waste landfill facility if the active area of the landfill is within 1,000 feet of residential property.
