     On page 4, after line 4 of the amendment, insert:

     "(7)  The jurisdictional health department may renew a permit for an experimental municipal solid waste facility only as a back-up facility until the jurisdictional health department has ten years of on-site data demonstrating that the experimental facility will not have adverse impacts to groundwater.  For the purposes of this subsection, an "experimental municipal solid waste facility" is a facility in which the design capacity is one hundred acres or more and the horizontal height at design capacity is, on average, one hundred feet or more above existing site elevations."

EFFECT:  Requires local health jurisdictions to renew the permit of an experimental landfill as a back-up facility  until the jurisdiction has collected ten years evidence demonstrating the ability of the landfill to protect groundwater.
