     On page 2, line 24, after "10.95 RCW" insert ", unless the department of corrections can reasonably estimate that an organ transplant could be less expensive than maintaining the on-going medical treatment for the condition.   The determination of cost efficiency shall be based on a comparison of the total medical costs for maintaining the inmate on treatment during the estimated time remaining prior to the execution versus the total costs for conducting and maintaining the inmate's organ transplant over that same period of time.  The secretary of the department of corrections shall review the cost comparison and make the final decision on which medical procedure is less expensive"


 

 

 

EFFECT:  The Department of Corrections is required to conduct a cost comparison on any inmate who is  sentenced to death and requires a transplant to assess if the cost of providing the transplant would be less expensive than maintaining the inmate on an on-going treatment prior to the planned execution. The Secretary of the Department of Corrections is required to make the final decision on the medical procedure used.
