Providing that
filled or altered wetlands shall not be considered or treated as wetlands.
AN ACT Relating to the
filling or altering of wetlands; and adding a new section to chapter 75.20 RCW.
BE IT ENACTED BY THE
LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec.
1. A new section is added
to chapter 75.20 RCW to read as follows:
The department may not
require mitigation for adverse impacts on fish life or habitat that occurred at
the time a wetland was filled, if the wetland was filled under the provisions
of RCW 75.20.300.
