    On page 2, after line 8 of the amendment, insert the following:

    "NEW SECTION. Sec. 3.  A new section is added to chapter 9A.44 RCW to read as follows:

    The state of Washington may be subject to a civil action for damages in an amount of not more than three thousand dollars when a person who is charged with a crime under section 1 or 2 of this act is found not guilty.  In addition, the state of Washington shall reimburse such person for all reasonable costs, including loss of time at work, legal fees, and other expenses involved in his or her defense."

    Renumber the remaining sections consecutively and correct any internal references accordingly.

EFFECT:  Allows the employee to bring a cause of action against the state when he or she has been falsely accused.
