AN ACT Relating to hospice care; adding a new section to chapter 41.05 RCW; adding a new section to chapter 48.20 RCW; adding a new section to chapter 48.21 RCW; adding a new section to chapter 48.44 RCW; and adding a new section to chapter 48.46 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 41.05 RCW to read as follows:
(1) Any state-purchased health care that provides coverage for hospice care may not require, as a condition of that coverage, that a person agree not to receive other covered medical care.
(2) For purposes of this section, "hospice care" has the same meaning as provided in RCW 70.127.010.
NEW SECTION. Sec. 2. A new section is added to chapter 48.20 RCW to read as follows:
(1) An insurer that offers an individual a health benefit plan that provides coverage for hospice care may not require, as a condition of that coverage, that the individual agree not to receive other care covered by the plan.
(2) For purposes of this section, "hospice care" has the same meaning as provided in RCW 70.127.010.
NEW SECTION. Sec. 3. A new section is added to chapter 48.21 RCW to read as follows:
(1) A group insurance contract or blanket disability insurance contract providing health care services that provides coverage for hospice care may not require, as a condition of that coverage, that a person agree not to receive other health care services covered by the contract.
(2) For purposes of this section, "hospice care" has the same meaning as provided in RCW 70.127.010.
NEW SECTION. Sec. 4. A new section is added to chapter 48.44 RCW to read as follows:
(1) A health service contractor that provides coverage for hospice care may not require, as a condition of that coverage, that a person agree not to receive other covered medical care.
(2) For purposes of this section, "hospice care" has the same meaning as provided in RCW 70.127.010.
NEW SECTION. Sec. 5. A new section is added to chapter 48.46 RCW to read as follows:
(1) A health maintenance organization that provides coverage for hospice care may not require, as a condition of that coverage, that a person agree not to receive other covered medical care.
(2) For purposes of this section, "hospice care" has the same meaning as provided in RCW 70.127.010.
