     On page 52, after line 13 of the amendment, insert the following:

A(d) Either the national marine fisheries service or the United States fish and wildlife service fails to promulgate an effective rule under 16 U.S.C. Sec. 1533(d) within five years after the date on which a fish species is listed as threatened or endangered under the endangered species act which prohibits actions listed under 16 U.S.C. 1538;@

     On page 52, line 14 of the amendment, strike A(d)@ and insert A(e)@

     On page 52, line 17 of the amendment, strike A(e)@ and insert A(f)@

     On page 52, line 17 of the amendment, after Athrough@ strike A(d)@ and insert A(e)@

     Correct any internal references accordingly.

EFFECT: Provides that failure of the national marine fisheries services or the Unites States fish and wildlife service to promulgate a rule under 16 U.S.C. 1533(d) which addresses acts prohibited under 16 U.S.C. 1538 will amount to a failure of assurances.
