     On page 50, line 37 of the amendment, after Aprocess.@ insert ANothing in this subsection shall be construed to effect the outcome of pending litigation regarding the department=s authority in making a threshold determination on a watershed analysis.@

EFFECT: Provides that the subsection shall not be construed to effect the outcome of pending litigation.
