     On page 88, after line 33, insert the following:

A(e) If an audit of an entity by the superintendent has identified overpayments made to the entity, amounts appropriated in sections 501 through 519 of this act may not be distributed to the audited entity until the superintendent enters into a repayment agreement with the entity for reimbursement of overpayment amounts as set by the superintendent.  All repayment agreements are subject to approval by the office of financial management and the state auditor.@

EFFECT:  The superintendent of public instruction may not provide funds to a state contractor that has been audited until the contractor has agreed to reimburse the department for any overpayments identified in the audit.  OSPI may continue to make payments according to current contractual obligations.
