On page 58, after line 26, insert the following:
"NEW SECTION. Sec. 307. If chapter __, Laws of 2001 (SB 6818) is not enacted by the effective date of this act, then the following sections of this act shall be null and void: 102, 107, 110 through 118, 137, 138, 140, 143, 150 through 154, 201 through 227, and 301 through 303.
NEW SECTION. Section 308. (1) If chapter __, Laws of 2001 (SB 6818) is not enacted by the effective date of this act, the governor shall instruct the office of financial management, for state building construction account--state projects approved in chapter 2001 2nd sp.s. c 8, to:
(a) Freeze the approval of all capital budget un-allotted projects;
(b) Rescind all approved capital budget allotments for projects that are not under contract on the effective date of this act; and
(c) Rescind the portion of an approved allotment that is not under contract when only a portion of the project is under contract.
(2) This section shall not apply to any allotments related to the housing assistance, weatherization, and affordable housing program, the farmworker housing assistance program, or the housing for homeless families with children program, commonly referred to collectively as the housing trust fund, in the department of community, trade, and economic development.
(3) Any allotments frozen or rescinded under section (1) of this section shall be so frozen or rescinded until June 30, 2003."
Renumber remaining sections consecutively and correct internal references accordingly.
EFFECT: If the bond bill does not pass by the effective date of the 2002 Supplemental Capital Budget, then the new bond-financed appropriations in the budget lapse. The Governor is instructed to have the Office of Financial Management freeze or rescind allotments on 2001-03 capital bond-financed projects that have not been allotted or are not completely under contract. The freeze or rescission applies through June 30, 2003. This does not apply to the Housing Trust Fund.
