ESHB 1034 - S AMD TO EEW COMM AMD (S2499.4) AMD 246

    On page 2, line 18 of the amendment, after "combustion." insert "Local air authorities may adopt rules regarding the use and kind of containers that may be used for outdoor burning within their jurisdictions.  Upon adoption, local rules adopted under this section shall supersede any rule on the same subject issued by the department or any fire district and may be less restrictive or more restrictive than any rule on the same subject issued by the department or any fire district."

EFFECT:  Allows local air authorities to adopt rules regarding the use and kind of containers that may be used for outdoor burning in their jurisdiction.  The rules supersede and may be less or more restrictive than rules on the same subject adopted by the Department of Ecology or by local fire districts.
