    On page 3, after line 4 of the amendment, insert the following:

    "(2)(a) The retailer making the sale of a sterile hypodermic syringe or hypodermic needle for the purpose of reducing bloodborne diseases is responsible for recording the required information in a register book as provided in (c) of this subsection.  The retailer may not sell a sterile hypodermic syringe or hypodermic needle for the purpose of reducing bloodborne disease to a person under age eighteen and must require the purchaser to supply identification so that the purchaser's true name, address, and age can be verified.  The retailer must keep the hypodermic syringes and hypodermic needles in a safe place that is not accessible to members of the public.  A retailer is required to show every purchaser of a sterile hypodermic syringe or hypodermic needle a copy of the law related to these requirements.

    (b) No person may obtain sterile hypodermic syringes or hypodermic needles for the purpose of reducing bloodborne diseases unless:

    (i) The syringes or needles are purchased for the purpose of reducing bloodborne diseases;

    (ii) The purchaser is at least eighteen years old; and

    (iii) The purchaser signs the register book for sterile hypodermic syringes or hypodermic needles with his or her true name and address and supplies proof of identification.

    (c)(i) Every retailer handling sterile hypodermic syringes or hypodermic needles must keep a hypodermic syringe and hypodermic needle register book in which the following statement must appear at the top of each page:  This is my true name, birthdate, and address.

    (ii) All sales of hypodermic syringes and hypodermic needles to reduce bloodborne diseases without a practitioner's prescription must be recorded in the hypodermic syringe and hypodermic needle register book and the following information must be recorded therein:

    (A) The printed name of the purchaser;

    (B) The signature of the purchaser;

    (C) The address of the purchaser;

    (D) The birthdate of the purchaser;

    (E) The quantity of sterile hypodermic syringes and hypodermic needles sold to the purchaser;

    (F) The date of the sale;

    (G) The initials or name of the retailer who sold the hypodermic syringes or hypodermic needles; and

    (H) Proof of identification.  This includes a driver's license or other state or federally issued photo identification card that has a unique identification number.

    (iii) All register books used to record the sale of hypodermic syringes and hypodermic needles must conform to the following standards:

    (A) The book must be eight and one-half inches wide and eleven inches long;

    (B) The book must be securely bound, not loose leaf or spiral bound;

    (C) The book must have its pages consecutively numbered with a unique number assigned to each book and identified on each page; and

    (D) Each page must consist of an original and duplicate.  If any sales are recorded, the duplicate sheet must be mailed to the Washington state board of pharmacy when completed or on the last day of each month, whichever is earlier.

    (d) All pharmacy records relating to hypodermic syringes and hypodermic needles are open to examination by the Washington state board of pharmacy investigators during normal business hours.  The refusal to permit such an examination constitutes grounds for the suspension or revocation of a pharmacist's license."
