Strike everything after the enacting clause and insert the following:

"NEW SECTION. Sec. I. It is the intent of the legislature to determine how to increase the effectiveness of penalties in deterring violations of the campaign finance and contribution limits, lobbying, political advertising, and public official's financial affairs reporting subdivisions of the public disclosure act, by increasing the likelihood that violators will be uncovered and punished in a manner and time frame most likely to create deterrence for violators while increasing voluntary compliance and respect for the law. It is further the intent of the legislature that the public disclosure act not be a deterrent to public participation in political activities, especially due to fear of unreasonable penalties and processes of enforcement.

NEW SECTION. Sec. II. There is hereby created the task force on the public disclosure commission, to investigate the operation and budget of the public disclosure commission and to make recommendations to the legislature for ways to increase the effectiveness of penalties in deterring violations of the campaign finance and contribution limits, lobbying, political advertising, and public official's financial affairs reporting subdivisions of the public disclosure act. The task force shall consist of the chair and ranking minority members of the senate state and local government and house state government committees or their designees, and four representatives of the public, one each chosen by the legislative members of the task force. A ninth member shall be a member of the public disclosure commission, chosen by the chair of the public disclosure commission. The task force shall examine the operations and budget of the public disclosure commission as they relate to enforcement of the campaign finance and contribution limits, lobbying, political advertising, and public official's financial affairs reporting subdivisions of the public disclosure act, and shall before December 1, 2002, make recommendations to the senate state and local government and house state government committees on ways to increase the likelihood that violators will be uncovered and punished in a manner and time frame most likely to create deterrence for violators while increasing voluntary compliance and respect for the law, and not deter public participation in political activities, especially due to fear of unreasonable penalties and processes of enforcement. The task force may consider different levels of fines, different manners of enforcement, and different structures for the public disclosure commission, including a separation of the recordkeeping and investigatory functions from the adjudicatory functions. The task force shall cease to exist on January 1, 2003."
