    On page 3, line 7, strike "The" and insert "Subject to subsection (2) of this section, the"

    On page 3 after "information." on line 25, insert the following:

    "(2) Prior to the director sharing a products's confidential statement of formula pursuant to subsection 1, the director shall notify the applicant or registrant of the product that it is proposed to be used by the department.  The notice shall provide the applicant or registrant of the product an opportunity to approve or object to the release of the product's confidential statement of formula that would be involved in the consultation process under subsection 1 of this section.  If within fifteen calendar days of receipt of notice, the applicant or registrant notifies in writing the department that they object to the release of the confidential statement of formula, the department shall not release the confidential statement of formula and the department may select an alternative product."

    Renumber the remaining subsections consecutively and correct any internal references accordingly.

EFFECT: Allows a registrant of a pesticide product proposed to be used by the Department of Agriculture to object to disclosure of confidential data by the department.  If an objection is made, the confidential data shall not be released and the department may select another product.
