_1      AN ACT Relating to the fair fund; and amending RCW 15.76.115.

_2  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

_3      Sec. 1.  RCW 15.76.115 and 1998 c 345 s 2 are each amended to read

_4  as follows:

_5      The fair fund is created in the custody of the state treasury.

_6  All moneys received by the department of agriculture for the

_7  purposes of this fund and from RCW 67.16.105(4) shall be deposited

_8  into the fund.  At the beginning of fiscal year 2002 and each

_9  fiscal year thereafter, the state treasurer shall transfer into

10  the fair fund from the general fund the sum of three million

11  dollars.  For each fiscal year after 2002, the state treasurer

12  shall adjust the total transfer by the fiscal growth factor, as

13  defined in RCW 43.135.025, forecast for that fiscal year by the

14  office of financial management in November of the preceding year.

15  Expenditures from the fund may be used only for assisting fairs in

16  the manner provided in this chapter.  Only the director of

17  agriculture or the director's designee may authorize expenditures

_1  from the fund.  The fund is subject to allotment procedures under

_2  chapter 43.88 RCW, but no appropriation is required for

_3  expenditures.
