HB 1148 - DIGEST

     Declares that knowledge is not an element of the crime of unlawful possession of a firearm in the first or second degree.  Unwitting possession is an affirmative defense to a charge of unlawful possession of a firearm in the first or second degree.  The defendant must establish the defense of unwitting possession by a preponderance of the evidence.
