   On page 1, line 9 of the amendment, after "misdemeanors." insert ""Criminal activity" does not include the medical use of marijuana as defined in RCW 69.51A.010."

   On page 1, line 20 of the amendment, after "assistance." insert "Nothing in this chapter shall apply to property or activities of a qualified patient or the patient's caregivers, family members, or members of the patient's household, based on the qualified patient's medical use of marijuana as defined in RCW 69.51A.010."

   On page 7, after line 6 of the amendment, insert the following:

   "Sec. 15. RCW 69.51A.050 and 1999 c 2 s are each amended to read as follows:

   (1) The lawful possession or manufacture of medical marijuana as authorized by this chapter shall not result in a nuisance action or the forfeiture or seizure of any property.

   (2) No person shall be prosecuted for constructive possession, conspiracy, or any other criminal offense solely for being in the presence or vicinity of medical marijuana or its use as authorized by this chapter.

   (3) The state shall not be held liable for any deleterious outcomes from the medical use of marijuana by any qualifying patient."

Correct the title and renumber the remaining section consecutively.

EFFECT: Provides that the criminal activity nuisance action does not apply to property or activities of patients, the patient's caregivers, family members, or members of the patient's household, based on the patient's medical use of marijuana, as defined under the medical marijuana law.
