Background: When water-sewer districts contract for engineering services, general provisions applicable to all state government, local governments, and special purpose districts are used. These general provisions are interpreted by some to preclude any discussion of the engineer's fee or rate structure prior to the selection of the most qualified engineering firm for purposes of negotiating a contract for water-sewer district purposes.

 

Summary of Bill: Water-sewer districts are given a choice in methods of contracting for professional engineering services. The district may use the general provisions for this type of contract or use the provisions specific to water-sewer districts. Water-sewer districts may require the engineering firm to submit its fee or rate structure along with its statement of qualifications or project proposal. The district may make its selection among the qualified bidders based on the lowest proposed fees or rates for the work.

Effective Date: Ninety days after adjournment of session in which bill is passed.
