AN ACT Relating to the election account; and adding a new section to chapter 29.04 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1 A new section is added to chapter 29.04 RCW
to read as follows:
(1) The election account is created in the state treasury, to be
administered by the secretary of state. The following money must be
deposited into this account:
(a) Amounts received from the federal government under Public Law
107-252 (October 29, 2002), known as the "Help America Vote Act of
2002," including any amounts received under subsequent amendments to
the act;
(b) Amounts appropriated or otherwise made available by the state
legislature for the purposes of carrying out activities for which
federal funds are provided to the state under Public Law 107-252,
including any amounts received under subsequent amendments to the act;
(c) Such other amounts as may be appropriated by the legislature to
the account.
(2) All earnings, including interest, from investments of balances
in the election account will be credited to the election account, and
may be used only for election account-related purposes.
(3) The secretary of state shall allot the funds in the account
exclusively to facilitate the implementation of Public Law 107-252.
