Regulating the authority of metropolitan municipal corporations to acquire property.

       Declares that a metropolitan municipal corporation shall not condemn lands for an essential public facility, provided for in RCW 36.70A.200, at a location outside its component county boundaries without first completing the city or county siting process for an essential public facility where the proposed facility is to be located, consistent with RCW 36.70A.200.

Revising voyeurism laws.

       Specifies the elements of the crime of voyeurism in the first degree and voyeurism in the second degree.

       Declares that voyeurism in the first degree is a class C felony.

       Declares that voyeurism in the second degree is a gross misdemeanor.

       Provides that no gross misdemeanor may be prosecuted more than two years after its commission; except that in a prosecution under RCW 9A.44.115(2) (b), if the person who was viewed, photographed, or filmed did not realize at the time that he or she was being viewed, photographed, or filmed, the prosecution must be commenced within one year of the time the person who was viewed or in the photograph or film first learns that he or she was viewed, photographed, or filmed.

Reducing the release of mercury into the environment.

       Requires that, no later than one year after the effective date of this act, every manufacturer listed under the act must develop a plan for ensuring that their products that contain mercury are properly collected, transported, and recycled. The plan must: (1) Identify either an existing or new collection system through which the used products can be returned for recycling or disposed of as hazardous waste; and

       (2) Identify a funding mechanism through which the manufacturer will fund the collection system.

       Provides that, effective January 1, 2004, no person may sell, offer for sale, or distribute for sale or use in this state a mercury-added novelty. A manufacturer of mercury-added novelties must notify all retailers that sell the product about the provisions of this act and how to properly dispose of any remaining mercury-added novelty inventory.

       Provides that, effective January 1, 2004, no person may sell, offer for sale, or distribute for sale or use in this state a thermometer that contains mercury.

       Provides that, effective January 1, 2006, no person may sell, install, or reinstall a commercial or residential thermostat that contains mercury.

        Declares that no person may sell, offer for sale, or distribute for sale or use in this state a motor vehicle manufactured after January 1, 2006, if the motor vehicle contains an automotive mercury switch.

        Provides that effective January 1, 2004, a health care facility may not purchase mercury manometers.

        Requires the department of general administration to, by January 1, 2004, revise its rules, policies, and guidelines to implement the purpose of this act.

        Declares that a violation of this act or any rule adopted under this act is punishable by a civil penalty not to exceed one thousand dollars for each violation in the case of a first violation. Repeat violators are liable for a civil penalty not to exceed five thousand dollars for each repeat violation. Penalties collected under this section must be deposited in the state toxics control account created in RCW 70.105D.070.

Creating the research and technology transfer commission.

        Creates the biomedical research and technology transfer account in the custody of the state treasurer. An amount equal to ten percent of the annual receipts for the state of Washington under the master tobacco settlement agreement from the tobacco settlement account must be deposited into the account. Expenditures from the account may be used only for grants awarded by the research and technology transfer commission and for operation of the commission established under this act.

        Creates the investing in innovation trust fund in the custody of the state treasurer.

        Provides that all court awards or court-approved or out-of-court regulatory settlements from actions taken by the attorney general in the areas of telecommunications, energy, and technology that are not specifically awarded for the benefit of identifiable parties to the legal action, or for court costs or attorneys' fees, or that are otherwise directed for deposit by statute, must be deposited into the trust fund.

        Creates the research and technology transfer commission.

        Specifies the duties of the commission.

        Declares that state energy strategy should be revised to consider the implications of wholesale market volatility upon the electric industry. To the extent that actions can be undertaken to encourage investment in additional generation resources, new technologies, and conservation, they should be pursued to minimize the impacts of wholesale market volatility on consumers, utilities, and independent power producers.

       Establishes a joint task force on long-term energy supply.

Regarding utility relocation costs.

       Provides that, if utility facilities must be removed or relocated as a result of the construction, alteration, repair, or improvement of a rail fixed guideway system as defined in RCW 81.104.015, the costs of the removal or relocation must be included in the costs of the system and paid by the authority. However, any additional costs associated with the upgrade of any existing utility facility that the utility elects to undertake must be paid by the utility.

       Provides that, if there is a dispute over costs, the costs will be submitted to an independent auditor agreed to by the parties. That auditor will determine if the costs were accurate and the auditor's decision will be final. The cost of the auditor must be paid by the party requesting the audit.

Establishing a permitting bill of rights.

       Finds that citizens of the state of Washington have the following rights when asked for a permit, license, or permission to engage in a lawful activity: (1) Right to a specific date in time for a yes or no decision on permits;

       (2) Right to a defined amount of information required to award permit by permitting authority before any application for permits can be accepted;

       (3) Right to know the exact maximum amount of costs in fees, studies, or public processes that will be incurred by the permit applicant;

        (4) Right to recover all costs and time lost in permitting processes from permitting authorities for transgressions or violations or abuse of authority in the rights set forth in this act, through civil process.

       Declares that these rights apply to permits, licenses, or other legal activity granting devices from all government entities chartered in the state of Washington for all laws or rules adopted after August 1, 2003, or all laws or rules changed or amended after August 1, 2003.

Creating a license plate emblem to benefit orca whale research.

       Finds that the creation of an orca whale emblem that will affix to a vehicle license plate will appeal to citizens interested in supporting orca whale research.

       Creates the orca whale research account in the custody of the state treasurer. All receipts by the department from the issuance of orca whale research emblems under this act shall be deposited into this account. Expenditures from the account may be used only for the costs of production of orca whale research emblems and administration of the program by the department, with the balance used only by the department for orca whale research in accordance with this act.

Prohibiting sale of violent computer and video games to minors.

        Provides that a person who sells, rents, or permits to be sold or rented, any violent video or computer game to any minor is guilty of a misdemeanor, punishable under chapter 9.92 RCW.

        Declares that "violent video or computer game" means a video or computer game that: (1) Contains realistic or photographic-like depictions of aggressive conflict in which the player kills, injures, or otherwise causes violence to a human form in the game who is depicted, by dress or other recognizable symbols, as a public law enforcement officer; and

        (2) Has been given a rating of "Mature," "For Adults Only," or an equivalent rating by the video or computer game manufacturer or any entertainment rating board commonly used by the video and computer game industry.

        Provides that, in instances where a tenant is unable to ascertain the physical location of the landlord by statement or posting, and service of a legal document is deemed necessary, the superior or district court having jurisdiction under RCW 59.18.050 shall approve the service of the legal document by certified mail to the address posted on the property owner's tax statement, or address provided to the tenant for payment of rent.

Requiring a performance audit of the utilities and transportation commission.

       Declares an intent that energy and telecommunications regulation reflect a less costly regulatory process that can ultimately benefit the consumer, eliminate duplication of functions, and improve government efficiency.

       Directs the joint legislative audit and review committee to conduct a performance audit of the utilities and transportation commission focused on its responsibilities regarding telecommunications, energy, and natural gas.

       Declares that, beginning July 1, 2003, through December 31, 2004, every electrical, gas, and telecommunications company subject to a fee under RCW 80.24.010 will pay to the commission a surcharge for the purpose of conducting a performance audit of the utilities and transportation commission by the joint legislative audit and review committee.

       Requires a preliminary report of the performance audit to be submitted to the appropriate legislative policy and fiscal committees by December 31, 2003, and must include the analysis of the commission's structure and functions and a work plan for the remaining activities of the performance audit.

       Requires a final report to be submitted to the appropriate legislative policy and fiscal committees by December 1, 2004.

       Directs the secretary or the secretary's designee to solicit proposals from private and nonprofit entities for a joint safety rest area demonstration project. To implement the demonstration project the secretary or designee shall negotiate and enter into agreements with private or nonprofit entities to provide safety rest area services.

       Provides that all revenues received under the terms of the agreement for the demonstration project must be placed in the motor vehicle fund. The department shall provide an initial report to the transportation committees of the house of representatives and the senate by December 1, 2004, and annually thereafter, on the status of the project and revenues received from the project.

        Pertains to the personally identifying information of persons who acquire and use a transponder or other technology to facilitate payment of tolls. The department of transportation may, at the secretary's discretion, disclose aggregate information on toll collection to governmental agencies or groups concerned with public transportation or public safety as long as the data does not contain any personally identifying information. Personally identifying information may be released to law enforcement agencies only if the request is accompanied by a subpoena.

       Recognizes that the department of fish and wildlife is charged with the responsibility of managing the state's fish and wildlife populations.

       Declares that, in order to accomplish this goal, the legislature recognizes that often elaborate and at times complex laws may be necessary.

       Finds that these laws, although necessary, can be confusing to the average sportsperson. Too often a hunter or fisher may wish to comply with the state's hunting and fishing laws, only to find that he or she did not properly interpret their meaning.

        Finds that, as historically drafted, the fish and wildlife code provides for a series of criminal infractions. The result of this construction is that a well-meaning sportsperson may face criminal charges if he or she unintentionally misunderstands or misinterprets a hunting or fishing law.

        Declares that the sports people of Washington deserve the benefit of the state's doubt that many first-time offenses are unintentional and are the unfortunate result of the complexity of modern wildlife management.

       Declares an intent to authorize the establishment of charter schools for the purpose of providing a unique setting for learning that will improve pupil achievement and provide additional public school choices for students, parents, and teachers.

       Provides that the Washington institute for public policy shall study the implementation and effectiveness of this act. The institute shall make recommendations to the legislature about the effectiveness of charter schools and the impact of charter schools. The institute shall also recommend changes to this chapter including improvements that could be made to the application and approval process. A preliminary report of the study is due to the legislature by September 1, 2005, and a final report is due September 1, 2007.

       Declares that the maximum number of charters that can be granted under this chapter is twenty in any given year commencing July 1, 2003, for the first four years. These annual allocations shall be cumulative so that if the maximum is not reached in any given year the maximum shall be increased accordingly for the successive years.

        Provides that the legislative authority of any county or any city may only adopt an ordinance imposing the excise tax authorized by this act if the ordinance is first authorized by a proposition approved by a majority of the voters of the taxing district voting on the proposition at a general election held within the district or at a special election within the taxing district called by the district for the purpose of submitting such a proposition to the voters.

       Requires that revenues generated from the tax imposed under this act must be used by the counties and cities solely for the maintenance and operation of park and recreation facilities acquired or developed with revenues from the taxes imposed under RCW 82.46.010 or 82.46.035 after December 31, 2002. Revenues from this tax may not be used by any county or city to supplant existing funding for maintenance and operation of park and recreation facilities.

       Provides that, by July 1, 2004, each state agency must review existing rules that exceed federal standards and prepare a report for the office of financial management and the joint administrative rules review committee that outlines the grant of authority used to exceed those standards.

       Requires that, if the agency has relied on a general grant of authority in adopting the rules, the agency shall either repeal the rules or seek specific authority from the legislature as allowed under this act. If specific authority is not obtained by July 1, 2006, the agency shall repeal the rule.

        Provides that, if the court determines that the offender, at the time of sentencing, has the means to pay for the cost of incarceration, the court may require the offender to pay for the cost of incarceration at a rate of fifty dollars per day of incarceration, if incarcerated in a prison, or the court may require the offender to pay the actual cost of incarceration per day of incarceration, if incarcerated in a county jail.

       (1) Advise the department on all aspects of the Puget Sound recreational fisheries enhancement program;

       (2) Review and provide guidance on the annual budget for the recreational fisheries enhancement account;

       (3) Select a chair of the committee. It is the chair's duty to coordinate with the department on all issues related to the Puget Sound recreational fisheries enhancement program;

       (4) Meet at least quarterly with the department's coordinator of the Puget Sound recreational fisheries enhancement program;

       (5) Review and comment on program documents and proposed production of salmon and other species; and
