(3) Appoint or remove the state actuary by a two-thirds vote of the select committee.

Addressing the department of fish and wildlife law enforcement officers' membership in the law enforcement officers' and fire fighters' retirement system plan 2 for periods of future service.
Provides that an employee who was a member of the public employees' retirement system plan 2 or plan 3 on or before January 1, 2003, and on the effective date of this act is employed by the department of fish and wildlife as a law enforcement officer as defined in RCW 41.26.030, shall become a member of the law enforcement officers' and fire fighters' retirement system plan 2. All officers will be dual members as provided in chapter 41.54 RCW, and public employees' retirement system service credit may not be transferred to the law enforcement officers' and fire fighters' retirement system plan 2.
Provides that an employee who was a member of the public employees' retirement system plan 1 on or before January 1, 2003, and on or after the effective date of this act is employed by the department of fish and wildlife as a law enforcement officer as defined in RCW 41.26.030, shall remain a member of the public employees' retirement system plan 1.

Making prescription drugs more available.
Declares an intent to develop a program to promote access to affordable prescription drug coverage to low-income persons who do not otherwise have adequate coverage to purchase necessary and appropriate prescription drugs.
Establishes a program to be known as the medicaid senior prescription drug program. Neither the benefits of, nor the eligibility for, the program is considered to be an entitlement.
Declares that eligibility for this program is limited to persons: (1) Who are age sixty-five and older; (2) whose family income does not exceed two hundred percent of the federal poverty level as adjusted for family size and determined annually by the federal department of health and human services; (3) who do not otherwise have insurance that provides prescription drug coverage; and (4) who otherwise are eligible under Title XIX and the state's federal prescription drug waiver program.

Providing penalties for elder fraud.
Provides that, when any person is found guilty of having committed an offense against an elderly person under chapter 9A.60 RCW, the court shall assess a penalty. The assessment shall be in addition to any other penalty or fine imposed by law and shall be in the amount of up to ten thousand dollars for a felony offense and up to five thousand dollars for a nonfelony offense.
Requires that money collected under this act shall be paid by the clerk of the court to the county treasurer who shall monthly transmit the money to the state treasurer for deposit as follows: (1) Fifty percent of the money shall be deposited in the violence reduction and drug enforcement account under RCW 69.50.520; and
(2) Fifty percent of the money shall be deposited in the public safety and education account under RCW 43.08.250, to be used solely for the crime victims' compensation program.
Provides that proceeds traceable to or derived from specified unlawful activity or a violation of chapter 19.86 RCW are subject to seizure and forfeiture if the violation was committed against an elderly person. The attorney general or county prosecuting attorney may file a civil action for the forfeiture of proceeds.
Provides that, unless otherwise provided for under this act, no property rights exist in these proceeds. All right, title, and interest in the proceeds vests in the governmental entity of which the seizing law enforcement agency is a part upon commission of the act or omission giving rise to forfeiture under this act.

Creating a law enforcement mobilization policy board and plan.
Declares that it is necessary to: (1) Provide the policy and organizational structure for large-scale mobilization of law enforcement resources in the state through creation of the Washington state law enforcement mobilization plan;
(2) Confer upon the chief of the Washington state patrol the powers provided in this act;
(3) Provide a means for reimbursement to law enforcement jurisdictions that incur expenses when mobilized by the chief under the Washington state law enforcement mobilization plan; and
(4) Provide for reimbursement of the host law enforcement agency when it has: (a) Exhausted all of its resources; and (b) Invoked its local mutual aid network and exhausted those resources.

Authorizing speeding enforcement on certain private roads.
Pertains to speeding violations under RCW 46.61.400 that occur on the private roads within a community organized under chapter 64.38 RCW, provided that: (1) A majority of the homeowner's association's board of directors of a community organized under chapter 64.38 RCW votes to authorize the issuance of speeding infractions on its private roads, and declares a speed limit not lower than twenty miles per hour;
(2) The president of the homeowner's association sends a notarized letter explaining the vote to the top law enforcement official of the city or county within whose jurisdiction the private road is located;
(3) The homeowner's association has provided written notice to all of the homeowners describing the new authority to issue speeding infractions; and
(4) Signs have been posted declaring the speed limit at all vehicle entrances to the community.

Creating a building mapping information system.
Recognizes the extreme dangers present when the safety of our citizens requires first responders such as police and fire fighters to evacuate and secure a building. In an effort to prepare for responding to unintended disasters, criminal acts, and acts of terrorism, the legislature intends to create a statewide first responder building mapping information system that will provide all first responders with the information they need to be successful when disaster strikes.

Provides that expenditures from this fund may be used solely for administering the fund and for payment of costs, expenses, and charges incurred in the preparation, initiation, and prosecution of criminal charges for violations of chapters 21.20, 21.30, 19.100, and 19.110 RCW.
Provides that any person who willfully violates any provision of chapter 21.20 RCW except RCW 21.20.350, or who willfully violates any rule or order under this chapter, or who willfully violates RCW 21.20.350 knowing the statement made to be false or misleading in any material respect, is guilty of a class B felony.
Provides that any person who knowingly alters, destroys, shreds, mutilates, or conceals a record, document, or other object, or attempts to do so, with the intent to impair the object's integrity or availability for use in an official proceeding under this chapter, shall upon conviction be fined not more than five hundred thousand dollars or imprisoned not more than ten years, or both. The fines paid under this provision shall be deposited into the securities prosecution fund.
Provides that a person who, in an administrative action by the director, is found to have knowingly or recklessly violated an administrative order issued under RCW 21.20.110 or 21.20.390 shall pay an administrative fine in an amount not to exceed twenty-five thousand dollars for each violation.
Requires the fines paid under this act to be deposited into the securities prosecution fund.

Directs the department of social and health services to report to the appropriate committees of the legislature on the implementation of the two pilot kinship care navigator projects with recommendations on statewide implementation of the pilot projects by December 1, 2004.
Declares an intent to assist children in the care of kin to access appropriate medical and education services. Children being raised by kin have faced barriers to medical care and school attendance because their kinship caregivers have not been able to verify that they are the identified primary caregivers of these children. Such barriers pose an especially significant challenge to kinship caregivers in dealing with school officials and health professionals when children are left in their care with little warning.
Provides that, to assist kinship caregivers in executing adequate and appropriate decisions regarding the educational and medical needs of a child in their care, a kinship caregiver's authorization affidavit is hereby created.
Provides that, within existing resources, the department of social and health services shall establish an oversight committee to monitor, guide, and report on kinship care recommendations and implementation activities.
Requires the kinship care oversight committee to report to the appropriate committees of the legislature on the status of kinship care issues by December 1, 2004.

Requires the board of natural resources to determine whether any special appraisal practices are necessary for logs sold by the contract harvesting processes, and if so, to adopt the special appraisal practices or procedures.
Requires the board of natural resources to establish and adopt policy and procedures by which the department evaluates and selects certified contract harvesters. The procedures must include a method whereby a certified contract harvester may appeal a decision by the department or board of natural resources to not include the certified contract harvester on the list of approved contract harvesters.
Requires the department of natural resources to provide a report to the appropriate committees of the legislature concerning the costs and effectiveness of the contract harvesting program. The report must be submitted by December 31, 2006.
Appropriates the sum of two hundred fifty thousand dollars for the biennium ending June 30, 2005, from the resource management cost account to the contract harvesting revolving account for the purposes of this act.

In an effort to prepare for responding to unintended disasters, criminal acts, and acts of terrorism, the legislature intends to create a statewide first responder building mapping information system that will provide all first responders with the information they need to be successful when disaster strikes.
Requires that, when funded, the Washington Association of Sheriffs and Police Chiefs shall create and operate a statewide first responder building mapping information system.
Requires the Washington association of sheriffs and police chiefs in consultation with the Washington state emergency management office and the Washington state fire commissioner's office to convene a committee to establish guidelines related to the statewide first responder building mapping information system.
Declares that units of local government and their employees, as provided in RCW 36.28A.010, are immune from civil liability for damages arising out of the creation and use of the statewide first responder building mapping information system, unless it is shown that an employee acted with gross negligence or bad faith.

(3) Provide a means for reimbursement to law enforcement jurisdictions that incur expenses when mobilized by the chief under the Washington state law enforcement mobilization plan; and
(4) Provide for reimbursement of the host law enforcement agency when it has: (a) Exhausted all of its resources; and (b) Invoked its local mutual aid network and exhausted those resources.

Declares that the purpose of the program is to provide grants to nonprofit, charitable organizations, incorporated under the laws of the state of Washington that do not discriminate in any way, and that provide nationally certified speech pathologists on a no-fee basis to children, regardless of their economic status, whether enrolled in a public, private, or home school, of preschool or school age, and who have displayed a lack of verbal communication skills; including in the grant application a finding that there is, on staff of the nonprofit, charitable organization, nationally certified speech pathologists trained in the techniques of teaching children essential communication skills. The superintendent of public instruction shall administer the grant program.
Establishes the "Help Kids Speak" license plate account in the custody of the state treasurer. All receipts, except as provided in RCW 46.16.313 (6) and (7), from "Help Kids Speak" license plates must be deposited into the account.

Provides that a commission employee certified by the federal railroad administration to perform hazardous materials inspections may enter the property of any business that receives, ships, or offers for shipment hazardous materials by rail, or that manufactures, marks, maintains, reconditions, repairs, or tests containers that are represented, marked, certified, or sold for use in the transportation of hazardous materials by rail. Entry shall be at a reasonable time and in a reasonable manner.
Declares that the purpose of such entry is limited to performing inspections, investigations, or surveillance of facilities, equipment, records, and operations relating to the packaging, loading, or transportation of hazardous materials by rail, pursuant only to the state participation program outlined in Title 49 of the code of federal regulations.

Finds that: (1) Burdensome, duplicative, and conflicting rules and regulatory programs are significantly hampering economic growth and prosperity for the citizens of Washington state.
(2) Multiple layers of redundant federal, state, and local environmental laws and regulations unnecessarily impede economic development and job creation while undermining Washington state's competitiveness in the national and global economy.
(3) The hydraulic project approval program was established prior to the enactment of the federal endangered species act, the state environmental policy act, shorelines management act, water pollution control act, water resources act, and the growth management act.
(4) The provisions of the hydraulic project approval program are now redundant or conflict with protective provisions adopted under section 4(d) of the federal endangered species act by the national marine fisheries service and the United States fish and wildlife service.
Declares that, notwithstanding the provisions of RCW 34.05.020, all rules made by the Washington state fish and wildlife commission relating to the hydraulic project approval program shall be repealed, without further action by the commission by July 1, 2003.

Changing water resource management provisions.
Provides that the department shall, through a network of water masters appointed under chapter 90.03 RCW, stream patrollers appointed under chapter 90.08 RCW, and other assigned compliance staff, achieve compliance with the water laws and rules of the state of Washington in the following sequence: (1) The department shall prepare and distribute technical and educational information to assist water users in complying with the requirements of their water rights and applicable water laws;
(2) When the department determines that a violation has occurred or is about to occur, it shall first attempt to achieve voluntary compliance by informing and educating the responsible person or persons regarding the law, the reason that the action or incipient action is not allowed under the law, and the potential penalties and sanctions that may be brought if compliance is not achieved. As part of this first response, the department shall offer technical information and assistance to the person in identifying alternative means to accomplish the person's purposes within the framework of the law; and
(3) If education and technical assistance do not achieve compliance, the department shall issue a notice of violation, a formal administrative order under RCW 43.27A.190, or assess penalties under RCW 90.03.600, unless the noncompliance is corrected expeditiously or the department determines no impairment or harm.
Declares that this act is not intended to prevent the department from taking immediate action to cause a violation to be ceased immediately if in the opinion of the department the nature of the violation is causing or is likely to cause immediate harm to other water rights or to public resources.

Declares an intent to improve the real estate excise tax reporting and collection process for the transfer of water rights that are transferred separately from the land.
Intends to improve reporting by requiring the department of ecology and water conservancy boards to provide the department of revenue with information about these transfers and to allow the reporting and payment of any real estate excise tax for these transfers to be made directly to the department of revenue, thereby relieving the counties of responsibility for collection of such tax payments and reports.
Intends for these improvements in processing to result in a simpler and more coordinated system for collection of the real estate excise tax for these types of water rights transfers.
