Providing incentives for the purchase of hybrid and fuel cell vehicles.
Finds that an appropriate goal would be for fifty percent of the motor vehicles sold to be hybrid and fuel cell vehicles by the year 2013. In order to encourage the citizens of Washington to pursue this goal through market incentives, the legislature shall reduce sales tax on these vehicles, and dedicate the remaining portion of the state sales tax to provide for other transportation alternatives.

Declares that the purpose of this act is to support the establishment and operation of habitat mitigation banks by: (1) Authorizing state agencies and local governments, as well as private entities, to achieve the goals of this act;
(2) Providing a predictable, efficient regulatory framework, including timely review of habitat mitigation bank proposals and approval of habitat mitigation bank credits for projects; and
(3) Establishing a preference for the use of habitat mitigation bank credits for transportation projects of statewide significance over individual, isolated, on-site mitigation.
Declares an intent that, in the development and adoption of rules for habitat mitigation banks, the department establish and use a collaborative process involving interested public agencies and private entities.

Managing clean and sober housing.
Provides that, if a tenant living in drug and alcohol free housing uses, possesses, or shares alcohol, illegal drugs, controlled substances, or prescription drugs without a medical prescription, the landlord may deliver a written notice to the tenant terminating the tenancy for cause as provided in this act.
Requires the notice to specify the acts constituting the drug or alcohol violation and must state that the rental agreement terminates in not less than forty-eight hours after delivery of the notice, at a specified date and time.
Requires the notice to also state that the tenant can cure the drug or alcohol violation by a change in conduct or otherwise within twenty-four hours after delivery of the notice.

Specifying when vacancies in certain county offices may be filled.
Provides that, if a vacancy occurs in a partisan county office after the general election in a year that the position appears on the ballot and before the start of the next term, the term of the successor may commence once he or she has qualified as defined in RCW 29.01.135 and shall continue through the term for which he or she was elected.
Declares that this act takes effect January 1, 2004, if the proposed amendment to Article II, section 15 of the state Constitution (HJR --) is validly submitted to and is approved and ratified by the voters at a general election held in November 2003. If the proposed amendment is not approved and ratified, this act is void in its entirety.

Providing courses of study options in public high schools.
Declares that all public high schools of the state shall provide, directly or in cooperation with a community or technical college, an apprenticeship committee, or another school district, for students the opportunity to take any or all of the following courses of study within each educational pathway required to be offered under RCW 28A.655.060(3)(c): (1) A course of study for students whose educational plans include the pursuit of a professional or technical certificate or degree that requires less than four years of postsecondary education. The program shall help these students receive industry certification upon completion of the program, and/or have the opportunity to articulate to postsecondary education and training programs related to their secondary program; and
(2) A course of study for students who are planning to defer further educational plans and enter the world of work upon graduation from high school. The program shall help students demonstrate the application of essential learning to the world of work, occupation-specific skills, knowledge of more than one career or job option within their chosen pathway, and general workplace skills.

Provides that each state agency shall, within available funds, develop and implement a quality management program to improve the quality, efficiency, and effectiveness of the public services it provides through business process redesign, employee involvement, and other quality management techniques.
Directs the senate and the house of representatives to each develop and implement quality improvement programs as described under this act by June 30, 2005, and to report the results of these efforts to the leadership of each major political party caucus within its respective house.
Encourages the supreme court to develop and implement quality improvement programs, as described under this act, for the judicial branch of government, by June 30, 2005, and to report the results of these efforts to the chief justice.
Encourages local governments to develop and implement quality management programs as described in this act.

Creating a voluntary organ and tissue donor registry.
Declares that the creation of a statewide organ and tissue donor registry is crucial to facilitate timely and successful organ and tissue procurement.
Finds that continuing education as to the existence and maintenance of a statewide organ and tissue donor registry is in the best interest of the people of the state of Washington.
Directs the department of licensing to electronically transfer to the federally designated organ procurement organization all information that appears on the front of a driver's license or identicard including the name, gender, date of birth, and most recent address of any person who obtains a driver's license or identicard who volunteers to donate organs or tissue upon death.
Provides that an applicant for a new or renewed registration for a vehicle required to be registered under chapter 46.12 RCW or chapter 46.16 RCW may make a donation of one dollar or more to the organ and tissue donation awareness account to promote the donation of organs and tissues under the provisions of the uniform anatomical gift act, RCW 68.50.520 through 68.50.630.

Creating a license for assisted living facilities.
Declares that the purpose of this act is to provide for the development, establishment, and enforcement of standards for the maintenance and operation of assisted living facilities.
Finds that assisted living facilities promote safe and adequate care as well as accommodate individual resident's changing needs and preferences; protect residents' rights; maximize residents' dignity, autonomy, privacy, independence, choice, safety, quality of life, and quality of care and encourage family and community involvement of the individuals who have chosen to make an assisted living facility their home.
Finds that many residents of community-based long-term care facilities are vulnerable, and their health and well-being are dependent on their caregivers. The quality, skills, and knowledge of their caregivers are often the key to good care.
Finds that the need for well-trained caregivers is growing as the state's population ages and residents' needs increase. The legislature intends that current training standards be enhanced without unduly creating impediments for those who wish to become caregivers.

Providing the department of fish and wildlife with a range of enforcement options to enforce the hydraulic code.
Finds that violations of the hydraulic code may range from relatively minor infractions to serious offenses. Many of the more serious offenses result in destruction of fish life and habitat because work is being conducted in an improper way, or at the incorrect time of the year.
Recognizes that, given the wide range in violations, the department of fish and wildlife needs a range of enforcement authorities. Minor offenses need to be dealt with as infractions with accompanying small fines, while serious offenses need to be prosecuted as gross misdemeanors.
Recognizes that, when violations lead to destruction of fish life and habitat, such actions must be expeditiously terminated, and that the violator must remediate the nonconforming site.
Seeks to provide the department with an increased range of enforcement authorities by directing that minor offenses be efficiently dealt with as civil infractions, and that orders may be issued to promptly stop work and provide for remediation at sites where violations of the hydraulic code are leading to the destruction of fish life and habitat.
Repeals RCW 77.55.140.

(2) He or she could reasonably summon assistance for the person in need without danger to himself or herself and without interference with an important duty owed to a third party;
(3) He or she fails to summon assistance for the person in need; and
(4) Another person is not summoning assistance for the person in need.
Provides that the duty to summon assistance is satisfied by making reasonable efforts to summon emergency police, fire, or medical assistance that identifies the location of the victim.
Declares that, except as provided in RCW 9A.76.050, failing to summon assistance is a misdemeanor.

Authorizing a transaction fee to fund an electronic pawnbroker and second-hand dealer reporting system.
Authorizes the chief of police to require pawnbrokers and second-hand dealers to collect a fee, not to exceed ten dollars or the actual per transaction cost, whichever is less, for each transaction for which each pawnbroker or second-hand dealer is required to record information under RCW 19.60.020.
Authorizes the county's chief law enforcement officer to require pawnbrokers and second-hand dealers to pay the transaction fee for pawnbrokers and second-hand dealers having their registered place of business in the unincorporated area of a county.
Provides that every month pawnbrokers and second-hand dealers required to collect the transaction fee under this act shall remit the transaction fee to the city or county treasurer. The city or county treasurer shall deposit the money in a special account to be used by the law enforcement agency only for establishing and maintaining an electronic pawnbroker and second-hand dealer transaction reporting system.
Requires a law enforcement agency collecting the fee authorized under this act to adopt the electronic reporting system recommended by the Washington association of sheriffs and police chiefs.
Directs the Washington association of sheriffs and police chiefs to convene a work group of law enforcement officers to identify and by July 1, 2004, recommend an electronic pawnbroker and second-hand dealer transaction reporting system.

(3) Measuring the effectiveness of prevention strategies; and
(4) Generating hypotheses that may lead to new scientific knowledge about the causes of, and most effective ways to fight, chronic diseases.
Declares it is the intent of the legislature in creating the environmental health tracking system to form a partnership to do all of the following: (1) Provide a continually updated data base, with linkages to the survey, biomonitoring, and disease data collected under section 3 of this act, in order to assess the impact of environmental contaminants on the human body;
(2) On an ongoing basis, track and evaluate a variety of chronic diseases in relation to environmental exposures, including state and local data on actual incidences of chronic disease;
(3) Make the data available to the public in an accessible and useful format; and
(4) Ultimately provide the data to the relevant board, division, or office within the department of health, the department of ecology, the department of labor and industries, and the University of Washington school of public health for the development of appropriate preventive strategies.

(2) A course of study for students who are planning to defer further educational plans and enter the world of work upon graduation from high school. Provides that, when an offender convicted of a sex or kidnapping offense committed on or after July 1, 2003, is classified as a level III offender, the department may not approve release to a residence, or any later residence, that is within one mile of any licensed day care facility, preschool, or any public or private primary or secondary school during any period that the offender is under supervision in the community.
Directs the department to require, as a condition of supervision, that all sex and kidnapping offenders under its authority convicted of a sex or kidnapping offense committed on or after July 1, 2003, and classified as level III offenders to wear an electronic home monitoring device at all times during their period of supervision in the community.
Provides that the offender shall pay the cost of electronic home monitoring as part of his or her cost of supervision. The department may add the cost to the current cost of supervision fees. If the offender is indigent, or the payment of the cost of electronic home monitoring would make the offender unable to pay restitution, child support, or other legal financial obligations, the department may waive or reduce the payment of the cost of electronic home monitoring.

Creating a pilot project to study the feasibility of privatizing liquor retailing.
Declares an intent for the franchising of the retail sale of liquor to result in a system that is more efficient than public sector retailing.
Intends to initiate a pilot project to close a portion of the state's liquor retail stores, to monitor the impact of the store closures on state revenues, and to consider closing more state liquor stores in the future if the initial store closures yield benefits for the state.
Provides that, notwithstanding any other provision of law, the board is directed to implement the closure of twenty-five state liquor stores by December 31, 2005. When determining which state liquor stores to close, the board must give due consideration to the timing of the expiration of liquor store leases, as well as input from the task force.
Provides that a state liquor store may not be closed unless at least one franchise exists in the franchise area covered by the liquor store, or unless the task force determines that reasonable alternative access is available to persons who previously purchased spirits from the state liquor store that is closing.
Declares that nothing in this act and RCW 66.08.150 shall be construed to eliminate liquor vendors as referenced in RCW 66.08.050, also known as contract agency stores, or to obligate liquor vendors to place bids for their stores.
Requires the task force created by this act to make a recommendation to the legislature by December 31, 2007, on whether the franchise system should be expanded, kept at its current level, or discontinued and replaced by the former state liquor store system.
