       Declares that it is unlawful for any person to seek or receive from any person or contract with any person for any fee or compensation for locating or purporting to locate any property which he or she knows has been reported or paid or delivered to the department of revenue pursuant to this chapter in excess of: (1) Five percent of the property's value during the twenty-four month period beginning when the property is paid or delivered to the department; or

       (2) Twenty percent of the property's value for the period beginning twenty-four months after the property is paid or delivered to the department.

Protecting sport shooting ranges.

       Finds that sport shooting ranges in this state offer valuable hunter and firearm safety training, legitimate and important forms of recreation to the general public, and provide the opportunity for many law enforcement agencies to maintain necessary firearms skills efficiently and at little or no cost.

       Finds that the continued existence and viability of sport shooting ranges is impacted by burdensome retroactive regulation and lawsuits, thereby potentially threatening the availability of low-cost firearms training to some local law enforcement agencies, as well as hunter and firearms safety training and recreation to the general public.

        Provides that, notwithstanding any other provision of law, a person who operates or uses a sport shooting range in this state is not subject to civil liability or criminal prosecution in a matter relating to noise or noise pollution resulting from the operation or use of the range if the range is in compliance with any noise control laws or ordinances that applied to the range and its operation at the time of construction or initial operation of the range.

        Requires each person circulating a ballot measure petition to sign before a notary public a statement contained on each sheet of the petition affirming, under penalty of perjury, that every person signing that sheet signed his or her name and correctly provided the accompanying information on the signature sheet, and that the person was eligible to sign the petition.

Reducing idling time and emissions.

        Requires each ocean marine terminal to operate in a manner that does not cause the engines of diesel trucks to idle or queue for more than thirty minutes while waiting to enter an ocean marine terminal. Accordingly, an ocean marine terminal will receive a citation and fine of two hundred fifty dollars for every truck that idles for more than thirty minutes while waiting to enter the ocean marine terminal.

       Provides that, in addition, an ocean marine terminal that takes action intended to avoid or circumvent the requirements of this act or to avoid or circumvent the reduction of emissions of particulate matter from idling or queuing trucks is subject to a fine of seven hundred fifty dollars per truck per violation.

       Declares that an ocean marine terminal does not violate this act by causing a truck to idle for more than thirty minutes while waiting to enter the gate into a marine terminal, if the delay is caused by: (1) Acts of God;

       (2) Labor disputes;

       (3) Declared state and federal emergencies; or

       (4) If the department of ecology or the state patrol finds that an unavoidable or unforeseeable event caused trucks to idle and that the terminal is otherwise in good faith compliance with this act.

Creating an intermodal container safety program.

       Finds and declares the following: (1) Under chapter 46.44 RCW, vehicles must meet certain gross vehicle weight restrictions to travel on state roadways. In addition, most states regulate the allowable gross weight on a single axle or set of axles. In this state, the maximum allowable gross weight on a single axle is 20,000 pounds and on a set of tandem axles is 40,000 pounds. Often, however, these axle weight limits are violated because containers are loaded with cargo well beyond any vehicle's axle or overall weight-bearing capacity.

       (2) Transporting overweight containers on public roadways presents significant dangers to the driver and the public. Due to the weight, balance, and force of the load, a driver transporting an overweight or improperly loaded container requires increased braking distance to reach a complete stop. Moreover, a higher center of gravity coupled with an overweight or unbalanced load increases the risk of chassis separation and flipped rigs when a driver makes a turn.

       (3) The Washington state patrol should pursue more strict enforcement of existing state and federal laws regarding improperly packed and unsafely loaded intermodal containers, and maximum vehicle weight restrictions.

Creating the intermodal chassis roadability inspection program.

       Provides that an ocean marine terminal that receives and dispatches intermodal chassis shall implement and carry out the intermodal chassis roadability inspection program, as described in this act, in lieu of any inspection required by chapter 46.32 RCW for motor carriers and vehicles.

       Provides that no ocean marine terminal operator may tender to, or interchange with, a motor carrier, an intermodal chassis that fails to pass the inspection required by this act and that fails to meet the requirements set forth in federal motor carrier safety regulations of 49 C.F.R. Sec. 396. An ocean marine terminal operator tendering to, or interchanging with, a motor carrier such equipment shall provide certification that the chassis has passed the inspection set forth in this act. An ocean marine terminal operator who violates this provision will be fined five hundred dollars per occurrence.

        Declares that nothing in this act is meant to supersede the inspection requirement and standard under 49 C.F.R. Sec. 396 that requires ocean marine terminal operators to conduct annual inspections of chassis. Rather, this chapter imposes an additional requirement that ocean marine terminal operators inspect chassis on a routine basis.

        Provides that an agreement between a free venture industry and the department must be reviewed and approved by the correctional industries board of directors. The review must include an analysis of the potential impact of the proposed agreement on the Washington state business community and labor market, and must include a public hearing.

        Provides that public testimony must be allowed at the hearing, and the board shall notify each Washington business that has the same three-digit standard industrial classification code as the organization seeking the agreement of the date, time, and place of the hearing.

        Declares that the board may not approve an agreement that will have an adverse economic impact on a Washington business. For purposes of this provision, "Washington business" means a person subject to chapter 82.04 RCW.

Implementing the federal permit requirements for municipal separate storm sewer system permits.

       Finds that municipal separate storm sewer system permits are required for certain municipalities under the federal water pollution control act. While these programs provide numerous environmental and public health benefits, they also burden municipalities and their businesses and citizens with many costs and liabilities.

       Finds that municipal separate storm sewer systems are distinct from other storm sewer systems such as industrial storm sewer systems and construction site storm water disposal systems because they consist of complex, widely dispersed conveyance networks that drain public roads and other key elements of infrastructure; include numerous inlets and outfalls that can be difficult to locate and maintain; and intermittently and unpredictably receive large volumes of diffuse storm water that may be polluted by a wide variety of substances directly or indirectly produced by various activities of the public at large.

        Sets forth criteria in this act for development of municipal separate storm sewer system permits under the state's delegated authority to administer the federal municipal storm sewer system permit program and under the applicable waste discharge permit provisions of chapter 90.48 RCW.

        Declares that all terms, provisions, rights, and obligations in chapter 49.46 RCW shall be given the same meaning as given to comparable terms, provisions, rights, and obligations under federal law, 29 U.S.C. Secs. 202 through 262, and the regulations and statements of general policy and interpretation applying and interpreting those terms issued by the United States department of labor.

        Provides that, in any action or proceeding based on any act or omission on or after the effective date of this act, no employer is subject to liability or punishment for or on account of the failure of the employer to pay minimum wages or overtime compensation under Title 49 RCW if the employer pleads and proves that the act or omission complained of was in good faith in conformity with and in reliance on any written administrative rule, order, ruling, approval, or interpretation of the department, or any administrative practice or enforcement policy of the department with respect to the class of employers to which the employer belonged.

Awarding service credit under the teachers' retirement system plan 1 for military service.

        Provides that, after completing twenty-five years of creditable service, any member may have service in the armed forces that was performed prior to membership in the retirement system credited to him or her as a member. However, the total number of years of military service credit from all sources, as authorized by any statute, may not exceed five years.

        Does not apply to any individual, not a veteran within the meaning of RCW 41.04.005. Military service shall not be credited to any member who is receiving full military retirement benefits pursuant to Title 10 United States Code.

Providing incentives to increase transportation revenues by reforming laws limiting the provision of passenger-only ferry service.

       Finds that current statutes impose barriers to entities other than the state operating passenger-only ferries.

       Declares an intent to lift those barriers to allow entities other than the state to provide passenger-only ferry service.

       Directs the department of transportation to make its terminal, dock, and pier space available to operators of passenger-only ferries if the space can be made available without limiting the operation of car ferries operated by the department. The department may not charge any lease, rent, or fee in excess of fair market value.

Creating a statewide justice information network.

        Declares that the purpose of this act is to develop and maintain, in a cost-effective manner, a statewide network of criminal justice information that enables sharing and integrated delivery of justice information maintained in the state's independent information systems and that will: (1) Maximize standardization of data and communications technology among law enforcement agencies, jails, prosecuting attorneys, the courts, corrections, and licensing;

        (2) Reduce redundant data collection and input efforts;

         (3) Reduce or eliminate paper-based information exchanges;

        (4) Improve work flow within the criminal justice system;

        (5) Provide complete, accurate, and timely information to criminal justice agencies and courts in a single computer session; and

        (6) Maintain security and privacy rights respecting criminal justice information.

        Requires the board to file a report with the governor, the supreme court, and the chairs and ranking minority members of the senate and house committees with jurisdiction over criminal justice funding and policy by September 1, 2004, and not less than every two years thereafter. The report shall make recommendations concerning legislative changes and appropriations needed to implement, operate, and enhance a statewide justice information network to assure the availability of complete, accurate, and timely justice information.
